​PBL4506F: Refugee and Immigration Law

Course Description:

The course will concentrate on South Africa’s national and international obligations towards refugees. Students will attain a thorough understanding of the Refugees Act 130 of 1998, the UN Convention relating to the status of refugees (1951), as well as certain regional conventions, in particular the 1969 OAU Refugee Convention.

The work focuses primarily on the basic criteria for the attainment, denial, and withdrawal of refugee status and the rights and treatment of refugees. A review of the case-law of international, regional, and national courts will provide an understanding of how refugee law is interpreted and implemented.

In addition, the course will cover immigration law insofar as it impacts on refugees and study the constitution in regard to the rights of non-citizens in South Africa.
