PBL5653F: Refugee Law and Human Rights

Course Description:

The Right to SEEK Asylum
Part 1 of the course will focus primarily on the basic criteria for the attainment, denial, and withdrawal of refugee status in accordance with the 1951 UN Convention Relating to the Status of Refugees and certain regional instruments, in particular the 1969 OAU Convention, the South African Refugees Act (130 of 1998) and other relevant international legislation. Furthermore, a review of the case-law of international, regional, and national courts will provide an understanding of how refugee law is interpreted and implemented in South Africa as well as in other jurisdictions.

The Right to ENJOY asylum
Part 2 will set out the origins, developments and established principles of refugee rights in international human rights law and will focus on the regime of rights protected by the various instruments.

The Right to SOLUTION
Part 3 will focus on the rights to solution, that is, voluntary repatriation, local integration and resettlement.
